Bid Bargain Brothers

Terms of Service Revised as of January 12, 2026

 

  1. Registration 

To participate in Bid Bargain Brothers auctions, you must register for a free account and obtain a bidder number. Participants must be at least 18 years old. By registering, you confirm that all submitted information is accurate and truthful. Accounts with false or misleading information may be suspended or permanently banned. No membership fee is required. While a credit card is not required for registration, a valid and verified payment method must be added prior to bidding in auctions. 

 

  1. Public Online Auctions 

Bid Bargain Brothers auctions are online-only events. The highest bid when a lot closes is the winning bid. By placing a bid, you agree to these Terms of Service. All bids are binding agreements to purchase the item at the winning price. Bids placed in the last 5 minutes of a lot extend the auction by 5 minutes. Bid increments and auction timing may be adjusted to ensure a fair bidding experience. All items are sold as-is, with no warranty, and all sales are final unless otherwise specified in our return policy.

 

  1. Auction Format 

All auctions are conducted online. Lots (individual items or grouped items) close approximately every 30 seconds, with a soft close applied, meaning the lot remains open for 30 seconds after the last bid. Bidding continues until no new bids are received within 30 seconds. The highest bidder wins the lot. 

 

  1. Bidding 

Bids are binding. Bidding starts at $5, with predetermined increments based on current bid value. Users may set a “max bid” for automatic bidding. Max bids only increase if another bidder competes on the same lot. Once placed, bids cannot be decreased. Errors in bidding must be reported in writing immediately; no bids can be reversed after the lot enters closing. 

Bid Increment Scale: - $5 – $20: $1 increments - $21 – $50: $2 increments - $51 – $100: $3 increments - $101 – $250: $5 increments - $251 – $500: $5 increments - $501 and up: $10 increments p

 

  1. Buyer’s Premium 

Unless specified otherwise, a 13% buyer’s premium applies to each winning lot. These fees are added to the invoice. Please factor them into your bids. 

 

  1. Invoices & Payment 

Winning bidders receive invoices via email immediately after the auction closes. Payments are automatically charged to the payment method on file. Accepted methods: Visa, Mastercard, American Express, and Discover. Cash, checks, or third-party digital payments (Venmo, PayPal, CashApp) are not accepted. Payment must be completed within 48 hours of auction close. Non-payment may result in account suspension.

 

  1. Pick-Up 

Pickup locations and times are provided in auction details and on invoices. Lots not collected within five days are considered abandoned and may be resold with no refund. Abandoned items may be resold, donated, or disposed of at Bid Bargain Brothers’ sole discretion. Buyer forfeits any claim to the item or resale proceeds. Ensure your vehicle can accommodate all purchased items; partial pickups are not allowed. Bid Bargain Brothers has no duty to store items beyond the designated pickup period and assumes no responsibility for condition or security after that time. No bailment is created by Bid Bargain Brothers’ possession of any item after the auction concludes.

 

  1. Title and Risk of Loss 

Title to purchased items passes to the buyer upon payment in full. Risk of loss transfers to the buyer at the earlier of pickup or the expiration of the designated pickup period, regardless of whether the buyer has retrieved the items.

 

  1. Sales Tax 

Applicable Arkansas sales tax of 6.5% (or as required by law) will be applied to the total purchase (bid + buyer’s premium). Buyers claiming tax exemption must submit valid exemption documentation prior to bidding. No refunds of sales tax will be issued after invoicing.

 

  1. As-Is Condition 

All lots are sold as-is. Known defects may be shared, but items may be listed as used, damaged, open box or like new. Food items may be near or past “Best By” or “Sell By” dates. Inspect items carefully. Return eligibility is limited to cases of significant discrepancies (e.g., item not as described). Clerical errors, lotting errors, photo discrepancies, or omissions do not invalidate a sale.

 

ALL ITEMS ARE SOLD “AS IS,” “WHERE IS,” AND “WITH ALL FAULTS,” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

 

  1. Photos & Images 

Auction listings primarily feature photos of the actual lot. Stock images may occasionally be used and will be labeled as such. Review all photos and descriptions before bidding. 

 

  1. Return Policy 

All sales are final except for items significantly not as described. Variations in model, size, color, or minor defects do not qualify for returns. For LIKE NEW lots: Items must be inspected at pickup; once removed from the premises, returns are not accepted. 

 

  1. Abandoned Property 

Items not picked up within the designated period are considered abandoned. Abandoned items may be resold, and no refund will be issued.

 

  1.  Termination of Access


    Bid Bargain Brothers reserves the right to suspend or terminate any account, restrict bidding privileges, or deny access to future auctions if a participant violates these Terms & Conditions or engages in conduct that, in our sole discretion, may negatively impact the integrity, fairness, or operation of our auctions.

 

  1. Missing Items 

Customers are responsible for verifying their items at pickup. Once items leave the premises, refunds for missing items are not guaranteed. 

 

  1. Right to Pull Lots 

Bid Bargain Brothers reserves the right to remove lots from an auction at any time. Any bids placed on removed lots are nullified. 

 

  1. Discounts 

Promotional discounts, coupons, or credits may be offered at our discretion. 

 

  1. Payment Method Verification 

A $1 pre-authorization may be applied when adding a payment method. This is a hold and not an actual charge. 

 

  1. Account Responsibility 

You are responsible for all activity under your account. Report any suspected unauthorized use immediately. Bidding responsibly is encouraged. Any individual bidding under an account is deemed an authorized agent of the account holder, and the account holder remains fully responsible for all bids placed.

 

  1. No Credit Card Chargebacks 

By registering and bidding, you authorize Bid Bargain Brothers to charge your payment method for all amounts due. You agree not to initiate a chargeback without first contacting Bid Bargain Brothers to resolve the issue. If a chargeback is initiated, you agree that Bid Bargain Brothers may submit these Terms, auction records, bidding logs, invoices, and pickup records as evidence to the card issuer. You further agree to reimburse Bid Bargain Brothers for all costs, fees, and losses incurred as a result of any improper chargeback.

 

  1. Errors & Discrepancies 

Auction descriptions are believed to be accurate but may contain errors. Bidding constitutes agreement to purchase despite any errors. Items are sold as-is with no guarantees. Errors do not give rise to rescission, refund, or price adjustment. 

 

  1. Platform Availability 

Bid Bargain Brothers is not responsible for missed bids, system delays, or technical failures caused by internet outages, device issues, browser incompatibility, or third-party service interruptions.

 

  1. Privacy & Security 

We collect device and browsing information per our Privacy Policy. Payment data is processed securely through a third-party payment processor and is never stored on our servers. 

 

  1. Limitation of Liability 

Bid Bargain Brothers is not liable for damages related to auction items, use of the site, or inability to use the service. To the maximum extent permitted by law, Bid Bargain Brothers’ total liability shall not exceed the greater of $100 or the total buyer’s premium paid by the bidder in the applicable auction. In no event shall Bid Bargain Brothers be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of use, or loss of data, even if advised of the possibility of such damages.





  1. Agreement to Terms 

By registering and bidding, you agree to these Terms of Service. Bid Bargain Brothers may modify these Terms at any time. Continued use of the platform after changes constitutes acceptance. Electronic acceptance of these Terms is binding as if signed in writing.

 

  1. Severability

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

 

  1. Governing Law; Venue

These Terms are governed by and construed in accordance with the laws of the State of Arkansas, without regard to conflict-of-law principles. Any legal action or proceeding arising out of or relating to these Terms or any auction shall be brought exclusively in the state or federal courts located in Faulkner County, Arkansas, and the parties irrevocably consent to personal jurisdiction and venue therein.

 

  1. Jury Trial Waiver

THE PARTIES HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVE ANY RIGHT TO A TRIAL BY JURY in any action, proceeding, or counterclaim, whether in contract, tort, or otherwise, arising out of or relating to these Terms of Service, any auction, any transaction conducted through Bid Bargain Brothers, or the relationship between the parties. Each party acknowledges that this waiver is a material inducement to entering into these Terms and that each has had the opportunity to review these Terms and consult with counsel of their choosing.

 

  1. Force Majeure

Bid Bargain Brothers shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, power failures, internet outages, labor disputes, governmental actions, or system failures.
